These Terms govern your use of this Service; by using this Service and/or Web-Site, you accept these Terms in full. If you disagree with these Terms or any part of these Terms, you must not use this Service.
These Terms of Use are subject to change with immediate effect and you agree to abide by the same.
1. SERVICE:
As a part of Service we have uploaded a form for the provision of an online registration process to prospective artists to enable them to pursue working opportunities with Neela Films Productions Private Limited in a systematic approach. By providing your information you acknowledge that the information provided by you in this form made available through this Service on the Web-Site, is valid and authentic and is being provided on your own free will on a voluntary basis.
2. USE OF INFORMATION:
Prior to furnishing the personal information in any mode or medium through this Service, you agree and understand that your personal information will be used for any and all purposes, if and when required by Neela Films Productions Pvt. Ltd. in context with artist management services and/or otherwise and the same shall be disclosed to any other entity and/or any third party affiliated and/or associated to Neela Films Productions Private Limited. It is further clarified herein that Neela Films Productions Private Limited holds any and all rights to contact you and/or your references via call and/or e-mail and/or letter and/or in any other manner using the particulars submitted by you in the Form.
3. REPRESENTATIONS AND WARRANTIES:
- You undertake not to dispute any decision(s) made by Neela Films Productions Private Limited in connection to the Services and agree that all the decision(s) made by the Production House shall be final and binding upon you.
- You undertake to execute all documents; declarations etc. and provide all information that may be required by the Neela Films Productions Private Limited in connection to the Services.
- You state that you irrevocably consent to Neela Films Productions Private Limited, and their film crew and/or any person as authorised by Neela Films Productions Private Limited as deemed fit by Neela Films Productions Private Limited to jointly and/or severally interview you and also ask questions pertaining to your views on various subjects at any time.
- You also hereby grant to Neela Films Productions Private Limited the right to take motion and still pictures of you and your appearance (blurred/pixalated), and tape and photograph you, record voice, conversation, comments and any sounds made by you, including any performance of any musical composition(s), views and opinions exchanged on camera, and to obtain other information about you, including but not limited to your name, likeness, photograph, voice, dialogue, sounds, biographical information, personal characteristics and/or other personal identification as and when required and called upon for an audition and/or selected by Neela Films Productions Private Limited (collectively, the Footage and Materials), and to use the Footage and Materials in perpetuity, in any and all media now known and hereafter devised (in any manner it deems appropriate at its sole discretion, and without limitation). The Footage and Materials shall also include but not be limited to any and all material that I may create, write, provide or contribute to in connection with the Program at any time, including, without limitation, personal journals, photographs, webisodes, vlogs, blogs, video diaries, e-mails and text/picture messages.
- Neela Films Productions Private Limited shall be the sole and exclusive owner of all rights (including, without limitation, copyrights) in and to the Footage and Materials for the entire Universe in perpetuity. Any and all such Footage and Materials shall be deemed "works made for hire" specially ordered as part of the Services or other audio-visual work, and you waive the exercise of any moral rights, droit moral, performers rights and any other such special and analogous rights which you have presently or may have in future. To the extent you retain any interest in the Footage and Materials; you hereby grant and assign to Neela Films Productions Private Limited all rights of any nature in and to all such Footage and Materials. The rights granted herein shall also include but not be limited to the right to use, edit, modify, add, delete, dub and/or fictionalize, exhibit, distribute, license such recording, in whole or in part, without restrictions or limitation for any educational, advertisement, promotional, commercial/non-commercial purpose, ancillary products (e.g., merchandise), and/or license, further license, sub-license, assign, transfer etc., the Footage and Materials, the Services to any party in any platform, manner, media and medium, as deemed fit by Neela Films Productions Private Limited at its sole discretion and you further agree and undertake not to dispute the decision of Neela Films Productions Private Limited at any time. The said Footage and Materials can also be arranged, re-arranged, adapted, altered, and/or added to other material without any payments to you and at the discretion of Neela Films Productions Private Limited. To the extent that the assignment of the rights in relation to the future medium or mode of exploitation of the Footage and Materials is not held valid by the operation of law in any territory of the world, notwithstanding the assignment of such rights in favour of Neela Films Productions Private Limited, you hereby also grant an irrevocable, exclusive, sub licensable, perpetual license for the entire word and in perpetuity to Neela Films Productions Private Limited, for such future medium or mode of exploitation of the work product as may be developed in the future, in consideration of the said payment, the sufficiency of which is hereby acknowledged by you.
- You hereby waive any right of inspection or approval of your appearance, Footage and Materials and/or use and/or exploitation of the same and you hereby agree not to assert any claim by yourself/through any other person, entity, organization etc., of any nature whatsoever, against such use of Footage and Materials granted hereunder. You undertake to indemnify and hold harmless, Neela Films Productions Private Limited, and their directors, representatives, employees, agents, parent companies, affiliates, subsidiaries, group companies, and/or any and all parties, etc. in relation to the Footage and Materials, Services and all other parties in relation/connected to the Services, and/or Neela Films Productions Private Limited against any claims, suits and/or litigations if filed in relation to your participation/appearance in the Services and/or in relation thereto, irrespective of the same being due to a known or unknown fact at the time of execution of availing the Services and further agree not to sue any party as stated herein and/or otherwise in connection/related to Neela Films Productions Private Limited either directly or through any party related/known to you in any way.
- You release the Neela Films Productions Private Limited, its directors, employees, contractors agents and any other related parties of Neela Films Productions Private Limited from and against any actions, claims and/or demands that I may have now or in the future in relation to the Web-Site and/or Services and any other use of whatsoever nature of the Web-Site and/or Services and/or the Footage and Materials and publicity and/or information provided by herein.
- You acknowledge that you are a volunteer and that you shall not be deemed to be an artist/ employee of Neela Films Productions Private Limited, nor shall you be entitled to the benefits provided by Neela Films Productions Private Limited to its artists/employees.
- You acknowledge that registration for the Service through this Web-Site does not guarantee and/or promise enrollment and/or signing-up of the user as an artist and/or otherwise in any other role, with Neela Films Productions Private Limited. You further agree that your selection solely depends on your ability to perform in the auditions, if any conducted.
4. INDEMNIFICATION:
In particular, Neela Films Productions Private Limited. and/or, its affiliates, and their respective directors, officers, employees, shareholders, vendors, partners, contractors, agents, licensors or other representatives and all of their successors and assigns (Parties) shall not be liable to you or anyone else for any loss and/or damage and/or injury suffered by you that arises out of the use of such personal information provided by you and/or otherwise and you shall further indemnify Neela Films Productions Private Limited and its Parties against the same.

PLEASE NOTE THAT NERLA FILMS PRODUCTIONS PRIVATE LIMITED FOLLOWS A STRICT RECRUITMENT POLICY AND NO OTHER THIRD PARTY SCHEMES FOR JOINING THE NEELA FILMS PRODUCTIONS PRIVATE LIMITED EXIST. IF YOU HAVE RECEIVED SUCH AN EMAIL OR OTHER CORRESPONDENCE, PLEASE BE ASSURED THAT IT IS NOT FROM ANY OFFICIAL SOURCE OF NEELA FILMS PRODUCTIONS PRIVATE LIMITED.
